A person can be charged with sexual conduct against a child in the second degree when, over a period of time not less than three months in duration, a person:
- Engages in 2 or more acts of sexual conduct with a child who’s less than 11 years old, or
- Who is 18 years old or older engages in 2 or more acts of sexual conduct with a child who is less than 13 years old.
There is a rule in the law that states a person cannot be subsequently prosecuted for any other sexual offense involving the same victim unless the other offense being charged occurred outside the time period being charged under the above law.
If the charge is a first degree crime, the law is similar as far as the time period is concerned, but also states:
- That one of the acts of sexual conduct includes at least one act of: sexual intercourse, oral sexual conduct, anal sexual conduct, or aggravated sexual contact with a child under the age of 11 years old, or
- That if the person is 18 years old or older and he or she has an act of sexual conduct (including the same acts listed above) with a child less than 13 years old.
