After you are arrested the police will take to the local police station for the booking process. Most likely you will be held in jail until you’re booked. During the booking process you will be:
- Photographed
- Fingerprinted
You may also be requested to provide some of the following (do not agree to providing any of the following before consulting your lawyer) depending on the criminal allegations:
- Blood and/or Urine Sample
- Hand Writing Sample
- Voice Sample
Your constitutional rights are that you be booked within a reasonable amount of time (from a few hours to overnight) after you have been put in jail. Even though defendants in criminal cases have a constitutional right to counsel, the courts view the booking process as routine administrative procedure rather than a criminal law proceeding. To protect you during the booking process, we will:
- Make sure your rights are protected and you do not incriminate yourself
- Make sure your booking process is not considerably delayed
- Make sure you do not hurt your defense case and start talking to police
- Provide ongoing comfort and advice
- Ask the judge for a writ of habeas corpus when necessary(which requires the police to bring you before the judge who decides if you are being legally held in jail).

What is Bail?
Bail is cash or the equivalent (bail bond) which a suspect can use in exchange for being released from jail. Release on bail is dependent on a person promising to appear in court at all scheduled proceedings. Bail may be granted to a person immediately after booking or at a later time after a bail review hearing. Alternatively, the accused may be released on his “own recognizance.” A suspect released on his own recognizance will not need to post bail, but must promise in writing to appear at all scheduled court appearances. Own recognizance release is granted after the court considers the seriousness of the offense, the person’s criminal record, any threat to the community and ties to family and employment.
