The Police Can Deliberately Mislead You in Order to Elicit Incriminating Replies

Lisa Pelosi: They are about to lie to you. They could tell you, “Come down. Nothing’s wrong. We just want to hear your side of the story,” but they know full well that they’re about to make an arrest. They’re inviting you in because it’s easier for them than having to track you down, and you walk right into the trap.

They can tell you things like, “Someone said you were there, and someone said to me … We have a witness that saw you there.” They could totally lie to have you say whatever it is that they want you to say.

People respond very differently to those situations. They often will keep you for hours, and they will kind of turn things around and lie to you. They’re making you say, many times, what they want you to say. That is why it’s important to have an attorney present, so that they can’t use their tricks to get what they’re looking for from you. They’re not there to help you.

It Is Advisable to Agree to Meet with Law Enforcement BUT Always in the Company of Your Attorney

Interviewer: If you get a call from a detective, how do you refuse without incurring more problems? What if they say, “If you don’t come down here, we’re going to come arrest you right now,” what do you do?

Lisa Pelosi: If you get a call from a detective, just be polite and say, “May I have your name and phone number? I’ll call you back immediately and let you know when I will be there.” Or you could just, “Yes, I’ll be there.” Then you immediately call the attorney and have the attorney call the detective.

Interviewer: As a regular citizen, are you allowed to lie to the police? Is there any consequence of you doing so?

Lisa Pelosi: In this particular situation, basically, to lie and say that you’ll be down, knowing full well that you’re going to call an attorney is a lie that you can do. This is because you are trying to protect your rights, in that case, there’s no issue for you to say something like that. There’ll be no consequence for that.
