New guidelines issued by the Justice Department are aimed at encouraging prosecutors to go after executives in white collar criminal and civil cases. The new guidelines mandate that corporations turn over evidence of wrongdoing against individual executives if they want credit for their cooperation. And encourages prosecutors to get as much information as possible on individual execs involved in the wrongdoing, before concluding their investigations.
Since the financial meltdown of 2008, public advocacy groups, watchdogs and the public in general have been critical of the Justice Department for not holding individual execs responsible and it appears these guidelines are in answer to that criticism.
Further, the Justice Department is directing its civil and criminal lawyers to work together on corporate investigations, with a focus on individuals. The new guidelines emphasize obtaining greater accountability from the individuals involved in corporate fraud as a way to deter corporate wrongdoing.
