Stalking is defined as repeated harassment and/or threatening behavior toward another person. The stalker can be a former partner (which is all too common), an acquaintance or a complete stranger. Stalkers are ex-husbands and wives, ex-boyfriends, people that are angry, infatuated or intent on repeatedly threatening another person via the internet or in person.
Cyberstalking is similar to stalking behavior because the stalker repeatedly harasses and pursues their victim using the internet and is sometimes likely to carry over into stalking in person, which can be dangerous and threatening to the victim.
Stalking laws vary by state, but stalking is generally considered to be any unwanted contact between a stalker and his or her victim that directly or indirectly communicates a threat or places the victim in fear. In New York State, the stalking laws allow the prosecution of persons who engage in an intentional course of threatening behavior and conduct. Courts now impose severe penalties against dangerous individuals found guilty of this crime.
Definition of Stalking and Penalties
- A person who repeatedly threatens the health, safety or property of a person, or repeatedly contacts or follows a person after being clearly told not to do so, faces up to three months in jail.
- A person who engages in a course of conduct that intentionally places another person in fear of physical injury, death or the commission of a sex offense, and any stalker who stalks three or more persons or has been previously convicted of stalking within 10 years, faces up to a year in jail.
- A person aged 21 or older who stalks a child, and a person who, while displaying a weapon, engages in a course of conduct that intentionally places another person in fear of physical injury, death or the commission of a sex offense, is guilty of a felony and faces up to four years in prison.
- A stalker who causes physical injury or commits another specified crime while stalking could face up to seven years in prison.
