cop-on-street

If you are stopped by the police, it can be an understandably tense time for you. As your local criminal defense attorney in New York, we have years of experience working with clients who have recently found themselves facing an interaction with the cops. So how do you best handle yourself in these inevitable situations? From being pulled over in your car to facing a cop on the street, we have some tips for you when interacting with the police.

Remain Calm

Although it may be difficult to do so, it is important that you remain calm when you encounter the police. No matter what the circumstances are for this interaction, remind yourself to keep from panicking. If you become agitated, angry, belligerent, or hysterical, you could worsen the situation. Take deep breaths and remind yourself to remain polite. No matter how the cops are acting, it is important that you continue to be calm and courteous.

Know Your Rights

When you interact with the cops, keep in mind that you still retain rights. No matter who you are, you are protected by the same constitutional rights as anyone else. Some of the rights you should keep in mind are the following:

    • The right to remain silent: If you wish to keep silent, let the cops know that you are exercising your right to remain silent. Sometimes keeping calm and quiet is the best option for you.
    • The right to refuse search: You do not have to consent to the cops searching your vehicle, your home, or your own person unless they have a warrant. Ask if they have a search warrant and if so to see it. Otherwise, let them know you wish to refuse the search. They may continue to search but repeat clearly and calmly that you do not consent to the search.
    • The right to leave: If you are not under arrest, you are allowed to leave of your own volition. Ask the cops politely if you are under arrest. If you are not, let them know you’d like to leave. Again, do not make a scene. Always remain calm and courteous so you do not escalate the situation.
    • The right to a lawyer: If you are facing arrest, keep in mind you are provided the right to a lawyer. Try to remain silent as much as possible and request your right to a lawyer. The sooner you contact us and let us assist you the better.

Keep in mind that while you have rights, you also have the obligation and responsibility to interact honestly with the cops. Never lie to a police officer and never obstruct or interfere with their work. If the end result of your police encounter is being arrested and charged, contact us right away.
